Who Can File an Injunction Against Workplace Harassment?

According to the Judicial Branch of Arizona in Maricopa County, an injunction against workplace harassment is a special type of protective order that is unique, because it is to be filed by “an employer or an authorized agent of an employer.” The employer or agent can file the injunction even if only one act of harassment has been alleged. Harassment, in this case, has been defined by the State of Arizona to mean “a single threat or act of physical harm or damage or a series of acts over any period of time that would cause a reasonable person to be seriously alarmed or annoyed…”

What Does an Injunction Against Workplace Harassment Do?

If an injunction is granted, the person who has been harassing may be legally prohibited from:

  • Going near the employer’s business or property;

  • Contacting the employer;

  • Contacting the harassed employee;

  • Contacting any other person at the employer’s business.

The prohibitions apply when the employer, employee, or other person is at the employer’s business, property, or working somewhere other than their normal business location. Other measures may be taken by the court to ensure the safety of those involved.
